1.1 These Terms and Conditions (hereinafter referred to as "T&Cs") of Connecting The Dots Global Limited (limited liability) (hereinafter referred to as the "Provider") apply to all contracts for the provision of services that a consumer or entrepreneur (hereinafter referred to as the "Customer") concludes with the Provider concerning the services presented by the Provider on its website. The inclusion of the Customer's own terms and conditions is hereby objected to unless otherwise agreed.
1.2 A consumer in the context of these T&Cs is any natural person who concludes a legal transaction for purposes that can predominantly be attributed neither to their commercial nor their independent professional activity. An entrepreneur in the context of these T&Cs is a natural or legal person or a legally responsible partnership that, upon concluding a legal transaction, acts in the exercise of their commercial or independent professional activity.
The Customer can make a non-binding request for a quote from the Provider by telephone, fax, email, letter, or through the online contact form provided on the Provider's website. In response to the request, the Provider will send the Customer a binding offer via email, fax, or letter for the provision of the service selected by the Customer. The Customer can accept this offer by providing a declaration of acceptance to the Provider by fax, email, or letter, or by paying the remuneration offered by the Provider within 7 (seven) days of receipt of the offer. The day of receipt of the offer is not included in the calculation of the period. For acceptance by payment, the day of receipt of payment by the Provider is decisive. If the last day of the period for accepting the offer falls on a Saturday, Sunday, or a public holiday recognized at the Customer's location, the next working day shall be substituted for such a day. If the Customer does not accept the Provider's offer within the aforementioned period, the Provider is no longer bound by the offer. The Provider will expressly point this out to the Customer in the offer.
Consumers generally have a statutory right of withdrawal. Further information on the right of withdrawal can be found in the Provider's withdrawal policy.
4.1 Irrespective of any statutory right of withdrawal that may exist, the Provider grants the Customer the right to cancel their appointment for a service provided by the Provider free of charge under the following conditions (contractual right of withdrawal):
4.2 The Customer may cancel their appointment up to 7 days before the start of the booked service without giving any reasons by providing a declaration to the Provider in text form (e.g., email). The timeliness of the cancellation is determined by the receipt of the declaration by the Provider. If the Customer cancels their appointment in due time, the Provider will refund any payment already made within two weeks of receipt of the declaration. The Provider may use the same means of payment for the refund that the Customer used for their payment to the Provider.
4.3 Any statutory right of withdrawal of the Customer remains unaffected by the contractual right of withdrawal set out above.
Unless otherwise stated in the Provider's service description, the prices quoted are total prices that include statutory VAT.
6.1 Information on the duration and termination of contracts, particularly regarding the termination modalities for services provided within the framework of continuing obligations, is provided to the Customer as part of the respective service description on the Provider's website.
6.2 The right to extraordinary termination for good cause remains unaffected. A good cause exists if, taking into account all the circumstances of the individual case and weighing the interests of both parties, the terminating party cannot reasonably be expected to continue the contractual relationship until the agreed termination or until the expiration of a notice period.
6.3 Terminations can be made in writing, in text form (e.g., via email), or electronically via the termination device (termination button) provided by the Provider on its website.
7.1 All legal relationships between the parties shall be governed by the law of the Federal Republic of Germany, excluding the laws governing the international sale of movable goods. For consumers, this choice of law applies only to the extent that the protection granted is not withdrawn by mandatory provisions of the law of the state in which the consumer has their habitual residence.
7.2 Furthermore, this choice of law regarding the statutory right of withdrawal does not apply to consumers who, at the time of conclusion of the contract, are not nationals of a member state of the European Union and whose sole place of residence and delivery address at the time of conclusion of the contract is outside the European Union.
If the Customer is a merchant, a legal entity under public law, or a special fund under public law with its seat in the territory of the Federal Republic of Germany, the exclusive place of jurisdiction for all disputes arising from this contract is the Provider's business location. If the Customer has their seat outside the territory of the Federal Republic of Germany, the Provider's business location is the exclusive place of jurisdiction for all disputes arising from this contract, provided that the contract or claims arising from the contract can be attributed to the Customer's professional or commercial activity. However, in the aforementioned cases, the Provider is also entitled in any case to bring an action at the court of the Customer's place of business.
